Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Smart’s products and services (the “Service”). By accessing or using Smart, you agree to be bound by these Terms.

1. Scope of the Service

Smart provides an AI-assisted analytics platform that enables users to analyze data from connected sources, including databases and spreadsheets, using natural language.

To operate the Service, Smart may:

• Access and map database schemas or file structures
  
  
• Process schema metadata and limited data samples (up to 10 rows per column) solely for query disambiguation
  
  
• Generate analytical outputs such as tables, charts, summaries, and SQL queries
  
  

Smart processes data in memory and does not maintain a persistent copy of customer query data or analytical results beyond what is required to operate the Service.

2. Account Access & Use

You are responsible for:

• Maintaining the confidentiality of your access credentials
  
  
• Ensuring that only authorized users access the Service
  
  
• All activity conducted through your account
  
  

You agree not to misuse the Service, attempt unauthorized access, or interfere with its operation.

3. Data Ownership & Processing

• Customer Data Ownership
  You retain full ownership of all data you upload or connect to Smart.
  
  
• Data Usage
  Smart processes customer data solely to provide the Service, in accordance with the principles described in the Smart Security, Privacy & Trust Overview.
  
  
• No Persistent Storage
  Smart does not store customer databases, spreadsheet contents, or query results beyond what is required to operate the Service.
  
  
• Model Training
  Customer data is not used to train foundation models unless explicitly agreed in writing.
  
  

4. Transparency & User Responsibility

Smart is designed to support auditability and verification.

Where applicable, users may:

• Inspect generated SQL queries
  
  
• Review execution logic and reasoning used to produce outputs
  
  

You are responsible for:

• Ensuring the accuracy and legality of the data you provide
  
  
• Reviewing outputs before using them for business or operational decisions
  
  
• Validating results using available transparency features
  
  

Smart provides analytical assistance and decision support only and does not provide professional, financial, legal, or regulatory advice.

5. Security & Deployment

Smart applies industry-standard security measures, including:

• Encrypted data transmission using TLS
  
  
• Isolated customer environments
  
  
• Optional regional deployments (e.g., EU-based deployments for GDPR considerations)
  
  

Customers are responsible for selecting deployment regions aligned with their regulatory and compliance obligations.

6. Beta & Early Access

The Service may be provided as part of a beta, pilot, or early access program.

Accordingly:

• Features may change, evolve, or be removed
  
  
• The Service may contain errors, interruptions, or limitations
  
  
• The Service is not guaranteed to be suitable for production-critical use
  
  
• Feedback provided may be used to improve the Service
  
  

7. Intellectual Property

Smart retains all rights, title, and interest in and to the Service, including its software, models, logic, interfaces, and documentation.

These Terms grant you a limited, non-exclusive, non-transferable right to access and use the Service during the term of your agreement. No ownership rights are transferred.

 

8. Limitation of Warranties

The Service is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law:

• Smart makes no warranties regarding accuracy, completeness, or fitness for a particular purpose
  
  
• Smart does not guarantee uninterrupted or error-free operation
  
  
• Outputs generated by the Service are not guaranteed to be correct or complete
  
  

9. Limitation of Liability

To the maximum extent permitted by law:

• Smart is not liable for decisions made based on outputs generated by the Service
  
  
• Smart is not liable for indirect, incidental, or consequential damages
  
  

Smart’s total aggregate liability arising out of or related to the Service is limited to the fees paid by you to Smart in the preceding twelve (12) months, or zero if the Service is provided free of charge.

10. Termination

You may stop using the Service at any time.

Smart may suspend or terminate access if these Terms are violated.
Upon termination, access to connected data sources is revoked.

11. Governing Law

These Terms are governed by the laws of Estonia, without regard to conflict-of-law principles.
